A breathing app by Alterras LLC
Anima is a wellness app, not a medical device. From version 1.3 it is free, and you can leave an optional tip. You own your data, we own the app, and the app is provided as-is. By using Anima, you agree to these terms.
These Terms of Service ("Terms") are an agreement between you and Alterras LLC, a New York limited liability company ("Alterras", "we", "us", "our"). They govern your use of the Anima mobile application for iPhone and Apple Watch ("Anima" or "the app"). By downloading, installing, or using Anima, you agree to these Terms. If you do not agree, do not use the app.
Anima is a haptic-guided breathing app designed to support mindfulness, relaxation, and general wellness. It offers guided breath patterns, ambient visuals, and optional session tracking.
Before using Anima, consult a qualified healthcare professional if you have or suspect any of the following:
Stop using Anima immediately and seek medical attention if you experience dizziness, lightheadedness, shortness of breath, chest discomfort, tingling in the hands or face, or any unusual physical symptoms during or after use.
Do not use Anima while driving, operating machinery, swimming, or engaging in any activity where reduced attention could cause harm.
From version 1.3, Anima is free to download and free to use, with every feature, on iPhone and Apple Watch. From version 1.3 there is no trial, no purchase to unlock anything, and no subscription for sale. Earlier versions are covered by "Purchases in versions before 1.3" in Section 14. If you want to support the work, you can leave an optional tip in the iPhone app. Full tip terms, and what happens to purchases made before Anima was free, are in Section 14 (Tip Terms) below.
All tips and purchases are processed by Apple through the App Store. Alterras does not receive, store, or have access to your payment information. For pricing, refunds, or billing issues, contact Apple Support directly at getsupport.apple.com. Apple's refund policy applies to all Anima tips and purchases.
Anima does not collect, store, or transmit personal data to us or any third party. All session history, preferences, and settings are stored locally on your device. Mindfulness session data may be written to Apple Health with your permission. For full details, see the Anima Privacy Policy.
You agree to use Anima only for personal, non-commercial wellness and mindfulness purposes. You will not:
Anima, including its code, design, visual elements, breath patterns, sounds, haptics, and all related content, is owned by Alterras LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the app for personal purposes. You do not acquire any ownership rights.
Any session data, notes, or moods you record in Anima belong to you and remain on your device.
ANIMA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERRAS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We do not warrant that Anima will produce any specific wellness, health, or mindfulness outcome.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERRAS LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF ANIMA.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF ANIMA IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN U.S. DOLLARS ($10), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless Alterras LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of Anima, your violation of these Terms, or your violation of any applicable law.
You may stop using Anima at any time by deleting the app from your devices. We may suspend or terminate your access to Anima if you violate these Terms. Upon termination, sections 5 through 13 survive and remain in effect.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Anima will be resolved exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will revise the "Last updated" date below and, where practical, provide notice within the app. Your continued use of Anima after changes take effect constitutes acceptance of the updated Terms.
From version 1.3, Anima is free, with every feature. If you want to support the work, you can leave a tip in the iPhone app at the level you choose: A coffee, A generous tip, or Pay it forward.
A tip unlocks nothing. Each tip is a consumable in-app purchase through Apple: a one-off payment, not a subscription, that you can repeat as often as you like. Every feature is already yours whether you tip or not.
Payment is charged to your Apple ID account at confirmation of purchase. There is nothing to renew and nothing to cancel. Prices are set in the App Store, may vary by region, and the price shown in the app at the time of the tip applies. Apple's standard refund policy applies to all tips; request a refund at reportaproblem.apple.com. Alterras cannot issue refunds directly.
Purchases in versions before 1.3. Versions of Anima before 1.3 start with a 7-day free trial that the app grants on your device; it needs no payment and does not turn into anything paid. Versions 1.1 and 1.2 then offer a one-time lifetime purchase at the price you choose (Supported, Standard or Pay it forward). Every tier unlocks the same app, does not renew, and gives permanent access on Apple devices signed in with the same Apple Account. Version 1.0 offered an auto-renewable subscription (monthly or yearly) and a one-time lifetime purchase. For an auto-renewable subscription: payment is charged to your Apple Account at confirmation of purchase; it renews at the same price and duration unless auto-renew is turned off at least 24 hours before the current period ends; your account is charged for renewal within 24 hours before the period ends; you can turn off auto-renew at any time in your App Store account settings. You, not Alterras, control your subscription; we cannot cancel or refund it for you. Versions before 1.3 may also give a period of free access for submitting the optional in-app feedback form; this is not a purchase. The price shown in the app at the time of purchase applies and may vary by region. Apple's standard refund policy applies; request a refund at reportaproblem.apple.com. From version 1.3 none of these are offered, every feature is free, and nothing you bought is taken away.
Anima is licensed, not sold, to you. These Terms grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes, subject to these Terms and to Apple's standard Licensed Application End User License Agreement (EULA), which is incorporated here by reference. Except as expressly granted, all rights are reserved by Alterras LLC, and the app is provided without warranty as described in Section 8.
